These Terms of Service (‘Terms’) govern your use of TruckBahi. By creating an account or continuing to use the Platform, you agree to these Terms. Read them carefully — they describe what we do, what you do, what happens when things go wrong, and the limits on both sides.
1. Who these Terms are between
These Terms are a contract between you (“you”, “Customer”) and TruckBahi Technologies Private Limited (“TruckBahi”, “we”), with registered office at To be updated before go-live. 2. The service
TruckBahi is a software-as-a-service transport book for small Indian road-freight transporters. It helps you issue Lorry Receipts (LR / builty), run party and driver ledgers, capture trip expenses, generate GST invoices (SAC 9965), and store compliance documents.
We provide the Platform, the hosted infrastructure, backups, security, and WhatsApp / phone support. We do not provide freight services, act as your agent, or become a party to any consignment contract between you and your parties.
3. Eligibility and accounts
- You must be at least 18 years old and able to enter a contract under Indian law.
- You must provide accurate organisation details (name, GSTIN, PAN, address) and keep them current.
- You are responsible for everything that happens under your account, including actions taken by users you invite.
- Keep your password confidential. Tell us immediately if you think a credential is compromised.
- We may refuse or close an account if you provide false information, misuse the Platform, or violate these Terms or Indian law.
4. Subscription and payments
TruckBahi is offered on a subscription basis. Pricing is shared on the first WhatsApp or phone call, based on your fleet size and usage. Unless otherwise agreed in writing:
- Subscriptions are billed monthly or annually in advance.
- Fees are exclusive of GST. GST is added at the prevailing rate and we issue a tax invoice.
- Payments are processed by Razorpay. You authorise Razorpay to charge the payment method you provide.
- If a payment fails, we will retry and notify you. If a payment remains unpaid, we may suspend access until dues are cleared.
Refunds and cancellations are governed by our Refund & Cancellation Policy.
5. Your data
You own the data you put into TruckBahi — parties, trucks, drivers, LRs, invoices, documents, ledgers. We are only a custodian. We will not access, use, or share your business data except as described in our Privacy Policy.
You grant us a limited licence to host, process, back up, display, and transmit your data so we can provide the service to you and your invited users.
You represent that you have the right to collect and share the data you enter (including data about your parties and drivers), and that its use on TruckBahi does not violate any law or third-party right.
6. Acceptable use
You agree not to:
- Use the Platform to issue fraudulent LRs, invoices, or tax documents
- Upload content that is unlawful, defamatory, obscene, or infringes another person's intellectual property or privacy
- Circumvent our security, reverse-engineer the Platform, or scrape the service at scale
- Resell, sublicense, or offer the Platform as a service to third parties without our written permission
- Use the Platform to transmit malware, phish users, send spam, or send unsolicited bulk communications
- Interfere with the functioning of the Platform or other customers' accounts
We may suspend or terminate your account for a material breach of this section.
7. Compliance with Indian law
You are responsible for running your transport business in compliance with applicable Indian law, including the CGST Act, 2017, e-way bill and e-invoice rules, the Income Tax Act, 1961, the Motor Vehicles Act, 1988, the Carriage by Road Act, 2007, and the requirements of your State Transport Department. TruckBahi assists with compliance (LR fields, GST rates, e-way bill numbers, FY-wise numbering) but does not replace professional tax or legal advice.
8. Availability and support
We aim for high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with prior notice and emergency maintenance without prior notice. Planned downtime is usually outside Indian business hours.
Support is available over WhatsApp, phone, and email during Indian business hours. We aim to acknowledge messages within one business day.
9. Intellectual property
The Platform — including its code, design, brand, logos, and documentation — is owned by TruckBahi and protected by Indian and international intellectual property laws. These Terms do not transfer any ownership to you. You may use the Platform only as these Terms allow.
Feedback you send us is appreciated and, by default, can be used by us without any obligation to you. Confidential information you clearly mark as such will be treated confidentially.
10. Third-party services
The Platform integrates with third-party services — hosting, payments, WhatsApp / SMS, analytics, and government portals (GST, e-way bill, e-invoice). Your use of those services may be subject to their own terms. We are not responsible for their content, availability, or changes they make.
11. Suspension and termination
- You may cancel at any time — see the Refund & Cancellation Policy.
- We may suspend or terminate your account on written notice if you materially breach these Terms, if required by law, or if continued service would expose us or other customers to material risk.
- On termination, you can export your data for 30 days. After that, we may delete it, subject to retention obligations under the Privacy Policy and Indian tax law.
12. Disclaimers
The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by Indian law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the Platform will be error-free, that every GST rate, HSN code, or e-way bill validity shown is current, or that documents generated will be accepted by every counter-party without change. You remain responsible for verifying the documents you issue.
13. Limitation of liability
To the maximum extent permitted by law, TruckBahi's total aggregate liability to you for all claims arising out of or relating to the Platform — whether in contract, tort, or otherwise — will not exceed the fees you paid us in the three months immediately preceding the event giving rise to the claim.
Neither party will be liable for indirect, incidental, consequential, or punitive damages, loss of profit, loss of goodwill, loss of business, or loss of data, even if advised of the possibility.
Nothing in these Terms limits liability that cannot lawfully be limited under Indian law (for example, liability for gross negligence, fraud, or wilful misconduct).
14. Indemnity
You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising from your use of the Platform in breach of these Terms, your data, or your violation of Indian law.
15. Force majeure
Neither party is liable for any failure or delay caused by events beyond reasonable control — including acts of God, war, riots, epidemics, government action, power failures, internet failures, and DDoS or similar attacks.
16. Changes to the service or these Terms
We may change the Platform to improve it, fix bugs, or respond to legal requirements. We may also change these Terms. For material changes to the Terms, we will notify you by email or an in-app banner at least 15 days in advance. Your continued use after the change takes effect means you accept the updated Terms. If you do not accept, you can cancel your subscription before the effective date.
17. Governing law and disputes
These Terms are governed by the laws of India. Any dispute will first be attempted to be resolved amicably. If that fails, the dispute will be submitted to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, seated in Gujarat, India, conducted in English. Subject to that, the courts of Gujarat, India will have exclusive jurisdiction.
18. Notices
Notices to us must be sent to [email protected]. Notices to you will be sent to the email or phone registered on your account, or shown as an in-app message.
19. Miscellaneous
- These Terms, the Privacy Policy, and any referenced policy form the entire agreement between us.
- If any part is held unenforceable, the remainder continues in force.
- Our failure to enforce a provision is not a waiver of our right to do so later.
- You cannot assign these Terms without our written consent. We can assign them in connection with a merger, acquisition, or sale of assets.
